Eligibility criteria for Massachusetts attorneys

Attorney Eligibility:

  • Licensed to practice law in Massachusetts
  • Physical office location in Massachusetts
  • Handling client funds that are nominal in amount
  • Holding client funds for short time periods

  • Pooled trust account structure
  • Dividens remitted to Massachusetts IOLTA Committee
Legal Authority: IOLTA accounts are governed by Massachusetts IOLTA rules and state bar association guidelines.

Required Documentation for IOLTA Account Opening

Attorney License & Practice Information:
  • Massachusetts Bar License (active status)
  • Business formation documents (if law firm entity)
  • Massachusetts office lease or ownership documentation
  • State Bar registration confirmation
Personal & Business Identification:
  • Personal government-issued photo ID
  • Business Tax ID (EIN) if applicable
  • Partnership agreement or operating agreement (if applicable)
  • Resolution authorizing account opening (for firms)

Important IOLTA Information: IOLTA accounts are governed by Massachusetts IOLTA rules and state bar association guidelines. All attorneys handling eligible client funds must establish an IOLTA account once they receive client funds that are nominal in amount or held for a short time period.

Interest Distribution: All dividens earned on IOLTA accounts is remitted directly to the Massachusetts IOLTA Committee to fund legal aid services for low-income Massachusetts residents. Clients do not receive interest from IOLTA accounts.

Account Opening: IOLTA accounts must be opened in person at our branch location. Proper documentation of Massachusetts law license and office location is required.
